    I believe I am a PAYING CUSTOMER, as such, I have a RIGHT to WORKING SOFTWARE. For the past month or two, I had no software, and you had my money. How in the world is that not theft?

    If anyone has more information on the DMCA, such that we can search for ways around this, please post it here.

          meh
          i guessed a "working" serial after installing, formatted my hard drive, installed xp and then gmpcm

          it still doesnt "work" properly
          export of .bin file and it tells you, you need the updated program

          manticor? you fudged the download page? lol
          just remove gmpcm if that is what they wish not ALL the downloads:P

              No the download page was disabled by the ISP. Demo or not, this is not my fight and frankly Im not intrested in commiting the time or resources to fight the battle. If Ben wants to deal with the owner of the software then he is welcome to.

              I did remove the offending files however the ISP has still not re-enabled the page.

The software, while as posted may be a demo and while may be abndoned is still property of Mick. On top of that he has instiuted measures to proctect the software which is covered under the Digital Mellinium Copyright Act. This act prevents the circumvision of protection measures except under certain circumstances.

                  Problem is for the most part the legal issues the DMCA presents are largely untested in court so there is little precendence. Which means if folks wish to contest the issue then it requires the courts to decide. The host is simply playing CYA and so am I. Neither of us have a desire to take to court a fight with which we have no involvment so in situations like this its best to err on the side of caution.

                  Like it or not even if its no longer distrubuited Mick is still the owner of the software and can license as he pleases. Should people who have actually paid for the software have an issue with this I suggest you take it up with Mick directly or contact your local attorny general as well as your own legal counsl in order to resolve the issue. You can't expect people to fight your battles for you.

                    Well put. Mick is the copyright owner to GMPCM. However, nobody has cracked any of his software. What was there was simply a trial version.

                    So phpBB and Mick are in the wrong here. Once it's restored, I suggest to any mods or admins to delete this page. No need for anyone to get into trouble over this whole mess, I'm sure that was nobody's intention.

                      It's not like Mick will sue anyone. He'd have to drive all the way to wherever and file against the person. And it's not criminal charges, so it's not like the po-po can arrest anyone for cracking GMPCM.

                      Obviously he's just being a pussy, and a whine ass. So how about we all just give him middle fingers? Since it's more than obvious that the loser is reading this site.

                        your correct its not a criminal matter its a civil matter. Where you are wrong is for one Mick doesn't have to drive anywhere, if he so chooses all he needs to do is hire a lawyer to file a brief in the district of his choosing. He can even file in his own district if he likes. It would be up to a court to decide if the district in which he filed is appropriate or the defendant can file a motion to have the venue changed.

                        Granted, he may be just bitching and being passive aggressive. However we don't own the servers. As a matter of fact I am covering the hosting for this site and I run about 8 other sites on this system. The ISP is being cautious as they do not wish to get tangled up in a possible court case for which they have no interest. They would shut down not just 660 but all my sites in the interest of avoiding a conflict. I don't blame them. 660 is hosted here for free and I'm not about to risk the other forums that run on this server nor will I risk the customers I have paying me good money to host them here. I would drop 660 as from my server well before any of that happened regardless of how any of you feel.

                        Yes its a sucky situation, but you guys are going about it in the wrong way and I'm sure you don't care because at the end of the day the only person that has anything to loose from it is me. If you had to risk something in this I'm sure you would think twice. Hell I have an ODBII car and I run DHP to tune my computer I have no need or care for GMPCM so there's even less incentive for me to care. I spent 3+ hours yesterday convincing my host to keep ALL my sites up over this. Sure 660 can changes hosts, however you will be hard pressed to find a host that will ignore such letters unless you start hosting the site in a country that does not recognize US laws or have similar laws.

                        Like I said before, if you have a problem with Mick or how he runs his business I suggest you take it up with him, your lawyer and/or your local attorney general.

                        I am locking this thread just so people reading it understand what the situation is. Further while I may not be a lawyer it seems there are quite a few people who are even more naive about how the legal system works than I am. I would recommend just staying quiet and handling your affairs over private channels for continued discussion of this matter.

                          I agree with joe 100%. If we can get our download section back up minus the GMPCM crap, thats cool with me. I do not have the time to read up on law so if someone else wants to pursue this then more power to them. My opinions really don't mean shit and i was hoping that the law wasn't going to cover software that has been abandoned, but I didn't check into it first. I am sorry for causing problems with your server joe, that was certainly not a situation I wanted you to be put in because of this site.

                            thanks ben. I understand. Its all good.

                            The download page should be working now (let me know if it isint) minus anything related to GMPCM. The categories are still there but all files have been removed.
