  • need some accident advice!!!

    Well here my problem. As many of you know at the beginning of the month my grandpa hit my car. Last Saturday I got hit again in the same spot. During the period between this my car was never fixed. There were no police involved either time, and both deals were to be done without insurance. Now when I called the girl who hit me last Saturday to tell her the estimate that i got, she didn?t pick up her phone. The thing is she is dating a friend of my best friend, so I know she will pay. The problem is that when I gave her boyfriend that amount, he didn?t think it was all from her. Is there any way to prove what damage is from what accident? Here on Mymonte I have threads from both accidents and pictures with both. Is this proof enough to prove that the second damage is from her??? Any advice on what to do is greatly appreciated! -Don

    That is a pickle indeed. Was your grandfather going to to give you some cash for it. Because I think that it would be fair to ask both parties for half and call it even. Given the problem with the dual damage, you wouldn't have a court case and you don't want to destroy relations either. If the insurance company may total it, I would avoid that like the plague. Because you will never get what you deserve. If you grandfather isn't going to pay I guess that's a family issue, and I'd get the half from the other party and suck-up the rest. Just saying that if I personaly were in a similar situation I'd be willing to pay half but would not want to pay more. If you do feel that the second accident was the worst you could use you pictures and maybe get some professionals to look at the pics and confirm your thoughts. Then you can go to her and say maybe you pay for 75% or something like that. I think that would be the best way to go.

      without police, and without pictures, its all a civil matter.

      Call your insurance company for help, or take them to court and plead your case. . .

        Hmm insurance will have to make the call. Are both you and the girl that hit you insured? It is her insurance that will likely pay for it. So they should just fix the damn thing if they are a good company.

        At least in my province it would work that way. I dont know about anywere else.

          Look forward to going to court. People may SAY that they will pay you, but when it actually comes to giving up the money, they more than likley will hesitate.

          Yeah it's going to be tough without police reports. If you can somehow get her to sign some sort of contract that says that she will pay you the amount of the damage, it will hold up in a civil court. You might want to first go to a bunch of car repair places and get a bunch of estimates and put the most expensive one on the contract. So if she does pay you, go to the cheapest place and pocket some money.

          But if it was me, I would get your papers going; start filing and send a summons, because it's the only way some people will get the idea. P.S. don't forget to sue her for costs. You don't wanna pay that crap.
