Actually it's a firmware mirror. And you need to use a specific drive too (Western Digital Scorpio WD1200BEVS for the 120gb variety- ~$54 bare).
I've read into it a good bit. From what I've read, you can use a larger than normal drive, but with the firmware that has to be there you can only use up to the size of drive you get the original firmware from. Got a 1TB, but 20GB hdd? 20GB for j00! I know they can't detect my cooling mod, but I've read about people that have consoles that got banned (they ban your console, not your gamertag) that only had an aftermarket fan installed. Other than that, only thing done to theirs was a RRoD fix from MS. To me, that doesn't pass the sniff test. I don't really want to take a chance on it for hard drive space. I've emailed a couple hard drive sellers (which replied back that theirs were both third party when I expressed concern about being banned from LIVE). To me, I can't see spending $70 on a 60GB USED hard drive from Gamestop. I can't imagine forking out $200 for a 120GB new unit. I'm not sure about what they run now, but you get the idea. So far as far as I know, 250GB seems to be the size limitation so far since there are systems with a 250GB drive included. But yeah, they do something to your box that messes it all up. It won't access the hard drive, it won't get online, it can't get game updates anymore and a couple of other things. That's pretty messed up if you ask me. If they ban mine for some reason, I won't buy another console or another game. I'm not playing pirated games, and I won't support a company that bans me for doing nothing wrong.
EDIT: Although playing Need For Speed Undercover in Dolby Digital 5.1 surround firing through Cerwin Vega LS-15's does have some serious appeal while piloting my fully built black Lamborghini Gallardo blasting down the highway at 220 mph, even in 480p
